Business Certificate / DBA

Massachusetts General Laws Chapter 110, Section 5 requires any person conducting business in the Commonwealth under any title other than the real name of the person conducting the business whether individually or as a partnership, shall file a business certificate in the Office of the Town Clerk where an office of any such person or partnership may be situated.

DBA's are issued in the TOWN your business is located in.

Your Business Certificate will be in effect for four years and must be renewed as long as such business continues to be conducted in the Town of Norfolk. The fee is $50. 

Exemptions to filing are allowed under section 6 if the corporation is doing business in its true corporate name, or if a partnership is doing business under any title, which includes the true surname of any partner. Certain other exemptions exist for trust and limited partnerships

The information required for a business certificate include:

  • Name and physical address of the business in Norfolk (a PO Box cannot be used for a business address)
  • If the business is located at a non-residential address, a copy of a lease agreement or notarized letter from the landlord stating the business as a tenant may be required
  • Name and residential address of the business owner(s) with photo ID

Violations

Please be aware that violations of M. G. L. Chapter 110, Section 5 are subject to a fine of not more than $300 for each month during which such violations continue.
